You are reading a legal document which is the agreement between You, the Customer (whom we refer to as “You”, “Your” or the “Customer” in this document) and us. We are Bizziebaby UK and we are the owner of this website. Bizziebaby UK, PO Box 323, Essex, RM13 0AT United Kingdom (and we refer to ourselves as “Bizziebaby UK”.
By using the Site and becoming a Bizziebaby Product tester, You are agreeing to these terms, as well as our Privacy Policy and all of these terms will govern Your use of the Site and our Services. If You do not agree to these terms, You must cease use of the Site and our Services.
These Terms and Conditions were most recently updated on 10 April, 2011. We reserve the right to amend these terms and conditions at any time. All amendments to these terms and conditions will be posted on-line. You may terminate this Agreement by written notice to us (by email at [email protected]) if You do not wish to be bound by such new terms and conditions. Continued use of the Service or the Website will be deemed to acceptance of the new terms and conditions.
Your statutory rights: As a consumer, nothing in this Agreement affects Your non-excludable statutory rights.
Your use of the Bizziebaby Testers Membership service
You agree that Your use of the Service will at all times be lawful. You agree not to post or transmit through the Website any material which violates or infringes in any way upon the rights of others, or any material which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offence, or otherwise violate any law, or which, without our express prior, written approval, contains advertising or any solicitation with respect to products or services. Any conduct by You that in Bizziebaby UK’s sole discretion restricts or inhibits any other end user of the Service from using or enjoying the Service is strictly prohibited. You agree not to use the Bizziebaby UK Website to advertise or perform any commercial, religious, political or non-commercial solicitation, including, but not limited to, the solicitation of other end users of the Service to become users of other on- or offline services directly or indirectly competitive or potentially competitive with Bizziebaby UK.
Age: To use the Website and/or the Service (whether with or without registration) and to make any Purchase, You must be 18 years of age or over.
Prevention on use: We reserve the right to prevent You using the Website and the Service (or any part of them) and to prevent You from making any Purchase.
You are solely responsible for Your Content submissions, including discussion posts on the Bizziebaby forum, profile information and links, pictures.
We will use any all reasonable endeavours to correct any errors or omissions, however we do not guarantee the Service or Website are free of faults and we do not accept any liability relating to such occurrences. In the event of discovery of an error or fault You should report it to [email protected]
We do not give any warranty that the service is free from viruses or anything else which may have a harmful effect on any technology.
The Website may be suspended, restricted or terminated at any time.
Registration and Your Bizziebaby Testers Membership Account
You do not need to register to browse the online reviews, but You must register and process Membership fee to become a Bizziebaby UK Review tester.
When registering as a Bizziebaby Tester and processing the annual membership fee you have a 28 day period to Cancel your Bizziebaby testers membership account. If after 28 days you do not cancel your you agree to all the Bizziebaby Membership fee terms and conditions. Once you are registered as a Bizziebaby Tester no refunds are given after the 28 day cancellation period.
We reserve the right to decline a new Registration or to cancel an account at any time.
Users must be resident in the UK.
You will be allocated password for Your account. You must keep this confidential and it is Your entire responsibility if You do not maintain the confidentiality of the password. You are solely responsible for anyone accessing the site using Your password and login details. You must notify us immediately if You become aware that someone is using Your login details without Your permission.
Any accounts that have been registered using someone else’s email address or a temporary address may be closed without notice or we may require users to re-validate their email addresses if we believe they have been using an invalid email address.
We reserve the right to close any accounts where users use multiple logins, non UK users pretending to be a UK user or where users use Proxy IPS to hide multiple accounts.
Bizziebaby Testers Membership
Users must register online and process annual Membership fee to become a Bizziebaby tester. The membership is valid for 1 year and you will be advised by email when your renewal is due. As a Bizziebaby tester you agree to receive item to keep and review and complete the Bizziebaby review questionnaire within the specified time scale provided. If you do not return completed questionnaires you are in violation of the Bizziebaby Testers membership terms and conditions and we have the right to cancel your membership immediately. If you do not complete the Bizziebaby Testers Membership questionnaire we will write to you requesting item to be returned as new to Bizziebaby UK. Should all requests be declined and item not returned Bizziebaby UK will raise invoice for the full Retail Price of the item supplied less your annual membership fee.
By purchasing you Bizziebaby Testers membership annual programme You agree to Our terms and conditions and also to any specific terms and conditions related to the Bizziebaby Testers Membership fee.
The transaction is complete only when we email You confirming the transaction which is deemed as our acceptance and approval as an official Bizziebaby UK product tester. .
Bizziebaby UK does not warrant that any product or service promoted by this site will be available for purchase by any particular person.
Any attempt by a user to claim more Testers Memberships than permitted by using multiple identities or different identities will invalidate that Users purchases.
Refunds
As a Bizziebaby testers you have 28 days to cancel your Bizziebaby UK Testers Membership. Once the 28 days are complete and you have agreed to all our Bizziebaby UK Membership terms and conditions no refunds will be given for the annual membership fee.
If You wish to claim a refund for your Bizziebaby Annual membership fee you must claim in writing to [email protected].
After 28 days we do not provide refund.
Copyright, Intellectual Property & Content
All rights, including good will and trademarks are the property of Bizziebaby UK.
All intellectual property rights (including all copyright, patents, trademarks, service marks, trade names, designs (including the “look and feel” and other visual or non-literal elements whether registered or unregistered) in the Website and Service, information content on the Website or accessed as part of the Service, any database operated by us and all the website design, text and graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software (including applets and scripts) shall remain our property (or that of our licensors). You shall not, and shall not attempt to, obtain any title to any such intellectual property rights. All rights are reserved.
None of the material listed above maybe distributed, reproduced, copied or published without Our prior written consent.
Any material posted by Users or Merchants shall be considered non confidential and non-proprietary and You grant us rights to use or copy as deemed appropriate by Us.
Any comments, suggestions or improvements suggested by Users shall be deemed to remain our property and are not deemed to be submitted in confidence and no compensation is to be provided to the provider of the ideas and can be used by Bizziebaby UK without any limitation whatsoever.
If You are a copy right owner or an owners agent and You find content that infringes upon Your copyrights please contact [email protected] with evidence of ownership of copyright and information where copyright has been breached.
Users agree not to:
- post or use any Content that infringes the copyright, trademark, trade secret or other Intellectual Property Rights of others.
- Violate the privacy, publicity or other rights of third parties,
- Post content that is unlawful, defamatory, discriminatory, libellous, pornographic, obscene, abusive, threatening, harassing, pornographic, hateful, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate,
- Post content that is false or inaccurate
- Post content that could damage the reputation of Bizziebaby UK
Where users do not adhere to 5.7 we may, but are not obligated to terminate user accounts and/or remove content from the site.

All opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, or any other end users are those of the respective author(s) or distributors) and not of Bizziebaby UK . Neither Bizziebaby UK nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose.
Bizziebaby UK will not be held responsible for any loss of damage caused by Your reliance on the information obtained through the website. It is Your responsibility to evaluate the accuracy of the information, opinions and advice.
Any links to 3rd party websites are provided purely for Your convenience and access is purely at Your own risk.
Privacy policy
7.1 We do not store credit card details nor do we share customer details with any third parties.
General Rules
Nothing in this agreement constitutes a partnership, joint venture, employment relationship or agency and neither party shall have the right or authority to incur any liability, debt or cost or enter into any contracts or any other arrangements on behalf of the other.
You may not assign this Agreement or Your rights and obligations in whole or part to any third party. We shall have the right to assign or otherwise delegate all or any of our rights under this agreement to another person.
Our failure to enforce any provision of this agreement will not be considered a waiver of the right to enforce such a provision.
You agree that You are more than 18 years of age.
Force majeure: We shall not be liable for any breach of our obligations under this Agreement where we are hindered or prevented from carrying out our obligations by any cause outside our reasonable control, including by lightning, fire, flood, extremely severe weather, strike, lock-out, labour dispute, act of God, war, riot, civil commotion, malicious damage, failure of any telecommunications or computer system, compliance with any law, accident (or by any damage caused by any of such events).
Waiver: No failure or delay by a party to exercise any right or remedy provided under this Agreement or by law shall constitute a waiver of that (or any other) right or remedy, nor preclude or restrict its further exercise. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that (or any other) right or remedy.
Severance: All the clauses of this Agreement are distinct and severable. If any provision of this Agreement (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, void, unenforceable or illegal, the other provisions shall remain in force. Whilst the restrictions contained in this Agreement are considered reasonable by the parties in all the circumstances, if any part of such restrictions may be adjudged void but would be valid if any part thereof were deleted or if the period or area of restrictions were reduced, the said restrictions shall apply with such modifications that may be necessary to make them valid and effective.
Entire agreement: this Agreement contains the entire agreement between the parties and no pre-contractual statements, representations, warranties, inducements or promises made by either party and no other agreements whether oral or otherwise not embodied herein shall add to or vary this Agreement or be of any force or effect.
Notices: Unless otherwise stated within this Agreement, notices to be given to either party shall be in writing and shall be delivered by hand, electronic mail (other than, if You are sending a notice to us for the purpose of legal process) sent by fax or by pre-paid post, to You at the address You supplied to us or to us at our office.
Governing law: This Agreement (and all non-contractual relationships between You and us) shall be governed by and construed in accordance with English law and both parties hereby submit to the exclusive jurisdiction of the courts of England.
